1. Overview of Consumer Warranties

Consumer warranties are assurances made by sellers regarding the quality and functionality of their products. The UCC categorizes warranties into two main types:

  • Express Warranties: These are explicitly stated assurances by the seller about the quality or functionality of the goods.
  • Implied Warranties: These are warranties that are inferred by law based on the nature of the transaction and the relative situations of the parties.

Express Warranties

Express warranties can be created through:

  • Any affirmation of fact or promise made by the seller which relates to the goods and becomes part of the basis of the bargain.
  • Any description of the goods which is made part of the basis of the bargain.
  • Any sample or model which is made part of the basis of the bargain.

Implied Warranties

The UCC recognizes two primary types of implied warranties:

  • Implied Warranty of Merchantability: This warranty guarantees that the goods are fit for the ordinary purposes for which such goods are used.
  • Implied Warranty of Fitness for a Particular Purpose: This applies when the seller knows the particular purpose for which the goods are required and that the buyer is relying on the seller's expertise to select suitable goods.

2. Consumer Protections under the UCC

The UCC provides several protections to consumers, ensuring that they have legal recourses in cases where warranties are breached. These protections include:

  • Remedies for breach of warranty, including repair, replacement, or refund.
  • Protection against deceptive practices by sellers.
  • Rights to reject non-conforming goods.

3. Breach of Warranty and Remedies

When a seller breaches a warranty, the buyer has several remedies under the UCC, including:

  • Cancellation of the contract.
  • Rejection of the non-conforming goods.
  • Recovery of damages.
  • Specific performance in certain cases.
